1. Who we are and these terms
The website fittopractisesg.com and the Fitness To Practice courses are provided by Fitness to Practise ("Fitness To Practice", "we", "us"). You can contact us at support@fittopractisesg.com or through our contact page.
By creating an account, buying a course or using the website, you agree to these terms, our refund policy and our privacy policy. If you do not agree, please do not use the website or courses.
2. What we provide
We provide online, self-paced educational courses on ethics, professionalism and related topics for regulated health professionals, in separate country editions (currently New Zealand and the United States). Each course includes lessons, knowledge checks, a final assessment, a certificate of completion and a structured reflective account template.
Course content is written from official sources and checked at the date stated in the course. Laws, codes and regulator guidance change; we review courses when they do, but we cannot guarantee that every course reflects every change on the day it happens.
3. Education only: no advice, approval or guaranteed outcome
- Independent provider. We are not affiliated with, accredited, approved or endorsed by any regulator, responsible authority, tribunal, state board or professional body.
- No CE/CME credit or approval. Our courses are not accredited continuing education or continuing medical education and are not board-approved. Whether a course counts towards recertification, continuing competence or license renewal is decided by your regulator or board, not by us.
- Not legal or professional advice. Courses are general education. For advice on your own position, speak to a lawyer, your union or professional association, or your indemnity insurer; the courses do not replace that advice.
- No outcome guarantee. Completing a course does not guarantee any outcome in a complaint, investigation, hearing, order, renewal or employment process.
- Orders and conditions. If a regulator, tribunal or board has required you to complete education, it is your responsibility to confirm that a course meets the terms of that requirement before you buy it.
4. Your account
- You must give accurate information, including your real name, because it appears on your certificate.
- Your account is personal to you. Do not share your login, let someone else take a course or assessment for you, or take one on someone else's behalf. Certificates issued in breach of this rule are invalid and may be withdrawn.
- Keep your password secure and tell us promptly if you think your account has been used without permission.
- One account can hold courses from any country edition.
5. Buying a course
Prices are shown in the currency of the country edition (for example NZ$ or US$) and are charged at checkout by card through our payment provider. Any taxes that apply are shown at checkout. Your bank may charge its own currency conversion or international fees.
A contract is formed when we confirm your order by email. Access is given instantly in "My Courses". We may change prices at any time, but changes do not affect orders already confirmed.
6. Access to courses
Courses are self-paced. You may access each course you buy for as long as it remains available on the website, and we will give reasonable notice before withdrawing a course you have bought but not finished. Your certificate and reflective account can be downloaded once issued; we recommend you keep your own copies.
We aim to keep the website available at all times, but it may occasionally be unavailable for maintenance, updates or reasons outside our control.
7. Assessments and certificates
To receive a certificate you must complete the course and pass the final assessment of 20 questions at the pass mark of 80% (16 correct answers). If you do not pass, you can review the course and retake the assessment.
A Fitness To Practice certificate confirms that the named person completed the course and passed its assessment on the stated date, and states the estimated CPD hours. It does not certify accreditation, approval by any regulator or board, CE or CME credit, professional registration, or clinical or professional competence. You must not alter a certificate or present it as anything other than what it is. We may withdraw a certificate obtained dishonestly or in breach of these terms.
8. Acceptable use
You agree not to:
- copy, share, resell, publish or distribute course content, assessment questions or answers;
- use automated tools to access, scrape or complete courses or assessments;
- try to bypass security, payment or access controls, or interfere with the website;
- enter patient names or other information that identifies patients or third parties in reflections or messages.
We may suspend or close an account that breaches these rules. Where we do, we will tell you why, unless the law prevents us.
9. Intellectual property
All course content, text, questions, graphics, templates and the Fitness To Practice name and branding belong to us or our licensors. When you buy a course we give you a personal, non-exclusive, non-transferable licence to use it for your own learning. Your completed reflective account belongs to you.
10. Our responsibility to you
We will provide courses with reasonable care and skill. Nothing in these terms limits any rights you have under consumer protection laws that cannot be excluded, including the Consumer Guarantees Act 1993 in New Zealand and consumer laws in your US state.
To the extent the law allows, we are not responsible for decisions made by any regulator, board, tribunal, employer or other third party, for how you apply course content in practice, or for indirect or consequential loss. To the extent the law allows, our total liability to you for any course is limited to the price you paid for it.
11. Changes to these terms
We may update these terms from time to time, for example to reflect new country editions, legal changes or changes to how courses work. The updated version will be posted on this page with a new date. Changes do not apply to orders confirmed before the change, except where required by law.
12. Governing law and disputes
These terms are governed by the law of the country edition you buy from. If you buy a New Zealand course (prices in NZ$, pages under /nz/), these terms are governed by the laws of New Zealand, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply, and the courts and disputes bodies of New Zealand (including the Disputes Tribunal) have jurisdiction. If you buy a United States course (prices in US$, pages under /us/), these terms are governed by the applicable federal laws of the United States and the laws of the state in which you live, and disputes may be brought in the courts of that state. Future country editions will be governed by the law of that country.
If you have a concern, please contact us first so we can try to resolve it. Nothing in this clause removes any right you have to bring a claim in the courts or consumer forums of the country or state where you live, where that right cannot be excluded.
