The United States has no single national regulator and no national scheme of revalidation. Licensure and discipline belong to the states, and most boards measure ongoing learning in CE or CME hours. So why should a U.S. licensee invest in learning that usually does not earn hours? This lesson explains the professional, ethical and regulatory reasons.

In this lesson, you will be able to

Describe how separate state practice acts and boards influence what continuing competence looks like for you.
Identify ethical code provisions that make ongoing learning a professional duty.
Describe how failures of everyday practice, rather than lack of CE hours, typically lead to board action.

The regulatory picture: hours are a floor, not a ceiling

Each profession in each state has a practice act enforced by a state board. Most boards set CE or CME requirements for renewal. According to the Federation of State Medical Boards' August 2026 summary of state CME rules, nearly every medical board (63 of the 67) sets a substantial CME requirement, and around 55 mandate at least some topic-specific education. Requirements vary widely: for example, California physicians need 50 hours every two years of Category 1 credit, Texas physicians need 48 credits per two-year cycle, of which no fewer than 24 must be formal Category 1 or 1A and two or more must cover ethics or professional responsibility, and New York has no general CME hour requirement for physicians but does require specific coursework such as infection control and child abuse identification.

These rules are important, and you must meet them. But hours are a measure of attendance, not of performance. No board assumes that a licensee who completed the required hours is therefore safe, and nothing in a typical renewal form asks whether your practice actually changed. The gap between hours and performance is exactly where work-based learning sits.

What actually brings licensees before a board

When the FSMB summarizes why physicians are most often disciplined, the reasons include care below the accepted standard, improper prescribing, inadequate records, neglect of patients and unfinished CE. Nursing boards see medication errors, documentation failures and failures to assess or escalate. Pharmacy boards see dispensing errors and failures of verification. Almost all of these are failures of everyday performance, not failures to attend a course. When a board looks at what went wrong, it often finds a pattern that was visible at work for some time: repeated near misses, drifting documentation, outdated prescribing habits or feedback that was not acted on.

Why this matters for you

A licensee who regularly reviews their own practice, seeks feedback and acts on it is more likely to catch a problem early, before it becomes a patient harm or a complaint. If a concern is raised, a genuine record of that learning is also far more persuasive than a list of CE certificates.

Learning as an ethical duty

Every major U.S. professional code treats continuing learning as part of professional responsibility. The codes are ethical guidance and bind only the association's members, but boards and courts often refer to them.

Code	What it says about ongoing learning
AMA Principles of Medical Ethics, Principle V	Physicians are expected to keep studying, applying and advancing scientific knowledge, stay committed to medical education, and seek consultation and draw on other health professionals' skills where appropriate.
ANA Code of Ethics for Nurses (2025), Provisions 4 and 5	Nurses are "responsible and accountable for their practice" (Provision 4), and have duties to self that include "integrity and professional competence" (Provision 5).
APhA Code of Ethics for Pharmacists (1994)	Professional competence is one of the eight principles: pharmacists maintain their knowledge and abilities as medicines, devices and evidence change.
AAPA Guidelines for Ethical Conduct	PAs are expected to keep their knowledge and skills current and to recognize the limits of their competence, consulting when needed.
ADA Principles of Ethics and Code of Professional Conduct	Under nonmaleficence, dentists keep their knowledge and skills current and seek consultation or refer when appropriate.

Notice the words "apply" in the AMA principle and "accountable for their practice" in the ANA code. The duty is not merely to learn but to bring learning into practice. That is the core of work-based learning.

Other systems that already expect it

Many licensees already work inside systems that rely on work-based learning, even if they do not call it that. In ACGME-accredited residencies, practice-based learning and improvement is a core competency on which every resident is assessed. Under 42 CFR 482.22(a)(1), a Medicare-participating hospital's medical staff has to carry out periodic appraisals of its own practitioners, and accredited hospitals evaluate practitioners' performance through ongoing professional practice evaluation. Nursing departments validate competence before nurses take on new responsibilities. These systems are covered in Sections 2 and 4.

Case study

A pharmacist who met every CE requirement

A community pharmacist in Florida has completed her 30 hours every biennium, including the board-approved courses on medication errors and controlled substances. A board complaint follows a dispensing error in which a look-alike, sound-alike product was selected and the verification step was rushed.

During the investigation it emerges that the pharmacy had logged three similar near misses in the previous year. Each was noted, but no one reviewed them together or changed the workflow, and the pharmacist had not connected them to her own verification habits.

The learning gap

Her CE was complete. Her work-based learning was not: the near misses were information her practice was giving her, and it went unused.

What would have helped

A short review of the near misses, a change to shelf placement and a personal verification routine, with a note of what changed.

Board perspective

Boards may consider steps a licensee took before and after an event. Evidence of real learning from practice is generally more meaningful than additional generic hours.

Apply it

List the CE you completed in your last renewal cycle. Next to each item, write one thing in your practice that changed because of it. Where you cannot write anything, ask what work-based learning might have achieved instead.

Lesson 1.2 · Key points

U.S. licensure is state-based; CE and CME hours are a renewal minimum, not proof of safe performance.
Most board concerns arise from everyday performance failures that were often visible at work beforehand.
AMA, ANA, APhA, AAPA and ADA codes all treat applying learning to practice as a professional duty.
